Abstract

This paper analyses the system of secrecy in Mexico considering the Right to information as set forth in Article 6 of its Constitution. The paper examines the reasons justifying information secrecy, the authorities empowered to assess such secrecy, the procedures for its implementation, and the criteria obligating disclosure. Additionally, it addresses two specific aspects of the Mexican system: the nature of information incompatible with classification and the use of the harm test as an argumentative tool to balance the legal interests at stake. Without intending to draw direct comparisons, this study suggests some considerations that could be relevant for a potential reform of the official secrets system in Spain.
